Monica from KHQ Lawyers chats to Jacq and Dene about the final stages of surrogacy.

A number of legal requirements must be met and the process can take between three to six months.

For instance, in Australia the surrogate and the surrogate’s partner are listed as the child’s legal parents.

A “substitute parentage order” is required for the legal parentage to be transferred to the intended parents.

Monica also discusses the tricky aspects around who is responsible for making decisions regarding the child before the legal transfer of parentage, and what happens if the surrogate doesn’t want to relinquish the child?
