Homosexual offences were repealed in Victoria in the early 1980s and in 2014 an expungement scheme to remove the convictions of gay men charged with buggery led to the Victorian Parliamentary apology to those who fell victim to these historical laws of the land.
In Victoria, we’ve had protection from sexual orientation and gender identity discrimination since the year 2000, and lawful sexual activity discrimination protection since 1995, however, we still don’t have protection from sexual orientation or gender identification vilification. There’s still a way for the law to go until we are truly equal.
So what rights to LGBTIQ people have? How does the law protect you against discrimination? What do you do if you feel you have been discriminated against? Where do you go for help?
Taking action against discrimination can be distressing, however, legal representation can mean you are able to negotiate successful outcomes without having to bring cases to court or the Victorian Civil and Administrative Tribunal.
Aimee Cooper is Deputy Managing Lawyer of the Equality Law Program at Legal Aid Victoria and she joins Dean Beck to answer these and other questions about your rights as an LGBTI citizen.
