Fear of criminalisation could prevent those at risk being tested for HIV

Unlike in Victoria, the NSW criminal law sees a person living with HIV (PLHIV) as criminally liable for prosecution if they have intentionally transmitted the virus to their partner without informing them of their status.

While medical practitioners in NSW are required to forward the name of a PLHIV to the Health Secretary, a ‘de-identified’ notification is in place to protect the anonymity of a PLHIV; but the proposed change in legislation would see this exemption removed.

NSW Health say the change would help to retain more PLHIV on treatment but HIV activists fear the harm could outweigh the benefits.

This week Emma Arnold speaks to Nic Holas, co-founder of The Institute of Many (TIM) who says while NSW have good intentions the risk of being identified and potentially criminalised would deter people from being tested for HIV.

“[The NSW Government] are looking for more innovative ways to end HIV, but it’s absolutely an over-reach while we as a community still risk being criminalised and discriminated against,” says Holas.

Meanwhile new research reveals a staggering 52% of young Australians battling poor mental heath are too afraid to talk about their issues.

Stephanie McLean catches up with Chris Tanti, CEO of Headspace to find out about what the organisation is doing to tear down the stigma attached to mental health.
